HIPAA NOTICE OF PRIVACY PRACTICES
Your right to privacy in this medical practice is paramount, and we will never disclose any of your personal information without your express consent, unless required to do so by law.
This notice describes Oral Only’s policy for how medical information about you may be used and disclosed, how you can access this information, and how your privacy is being protected. Please read it carefully.
The Physician/Non-Physician Providers/Nurse Practitioners collectively known as “HEALTH CARE PROVIDERS” will acquire private information about their patients. This information is confidential and will not be discussed outside of our organization, except that HEALTH CARE PROVIDERS may discuss patient information with other healthcare professionals in a way that does not identify the individual.
Your protected health information (PHI), including your clinical records, may be disclosed to another healthcare provider or hospital if it is necessary to refer you for further diagnosis, assessment, or treatment.
Your healthcare and billing records may also be disclosed to third parties—such as insurance carriers, HMOs, PPOs, or your employer—if they are or may be responsible for payment of services provided to you.
Your name, address, phone number, and healthcare records may be used to contact you regarding appointment reminders, information about treatment alternatives, or other health-related services that may be of interest to you. If you are not available when we call, a message may be left on your voicemail or with someone in your household. You have the right to request confidential communications or limit how we contact you.
We may also be required to disclose your health information under the following circumstances:
- In the event of an emergency
- If required by law
- When there are substantial communication barriers and, in our professional judgment, we believe you would want us to provide care
- If ordered by the courts or other government agencies
- To public health authorities, law enforcement, coroners, or funeral directors
- In relation to organ donation, research, military service, or national security
You have the right to receive an accounting of any such disclosures made by our office.
Any use or disclosure of your PHI outside of what is outlined above will only be made with your written authorization.
Oral Only will maintain your health records for at least seven (7) years following your last encounter, with the following exceptions:
- For minors: Records, including immunizations, will be retained until the child reaches age 18 or becomes emancipated, and for a minimum of six (6) years after the last visit, whichever is longer.
- Transferred records: If your records have already been transferred to another provider or released to you or your legal representative, we may not be required to retain copies.
- Other obligations: Some records may be retained longer if required by contract or federal law.
Oral Only’s Duties Under HIPAA
At Oral Only, we are legally obligated to protect the privacy of your Protected Health Information (PHI) as required by the Health Insurance Portability and Accountability Act (HIPAA) and other applicable laws. This includes protecting the confidentiality, integrity, and security of your PHI.
Required by Law
We are required to:
- Maintain the privacy of your PHI
- Provide you with this notice detailing our legal duties and privacy practices
- Abide by the terms of this notice as long as it remains in effect
Use and Disclosure of PHI
All uses and disclosures of PHI will follow our internal policies and comply with HIPAA and state laws. This includes using your PHI for treatment, billing, administrative operations, and other legally permitted purposes.
Changes to Our Privacy Practices
Oral Only reserves the right to update or modify our privacy practices. Any material changes will apply to all PHI we maintain, and you will be notified of significant updates through an updated privacy policy.
Your Acknowledgment and Rights
By receiving services from Oral Only, you acknowledge your rights under HIPAA. These include the right to:
- Access, inspect, and obtain a copy of your PHI
- Request amendments to your PHI if you believe it is incorrect or incomplete
- File a complaint if you believe your privacy rights have been violated
We are fully committed to maintaining your privacy and complying with all HIPAA regulations.
